JapanScanner Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JapanScanner website, applications, software, and related services (collectively, the "Service").

The Service is operated by Nguyen Thanh Hieu, trading as JapanScanner ("JapanScanner", "we", "us", or "our").

By creating an account, accessing the Service, or purchasing a subscription, you agree to these Terms. If you do not agree with these Terms, you should not use the Service.

1. About JapanScanner

JapanScanner is a software-as-a-service ("SaaS") platform designed to help users monitor, research, and analyze product listing information from supported third-party Japanese online marketplace sources.

The Service may provide features including:

keyword monitoring; product and model monitoring; new listing detection; price monitoring; listing history; marketplace monitoring; notifications and alerts; research and analytical tools; and other software features introduced from time to time.

JapanScanner provides software access and related digital functionality.

2. JapanScanner Is Not a Marketplace

JapanScanner is not a marketplace, retailer, seller, broker, purchasing agent, proxy buying service, payment service, shipping provider, or fulfillment service.

JapanScanner does not:

sell the products displayed in monitoring results; allow users to list products for sale; facilitate transactions between buyers and sellers; process payments between marketplace buyers and sellers; purchase products on behalf of users; act as a purchasing agent or proxy buyer; provide shipping or forwarding services; or hold funds on behalf of marketplace sellers.

Any purchase or other transaction that a user conducts with a third-party marketplace or seller is independent of JapanScanner.

3. Third-Party Marketplace Sources

JapanScanner monitors information from selected third-party online marketplace sources.

Third-party marketplace names, trademarks, websites, and other intellectual property remain the property of their respective owners.

Unless expressly stated otherwise, JapanScanner is independent from and is not affiliated with, sponsored by, endorsed by, or operated by those third-party marketplaces.

Third-party sources may change their websites, interfaces, availability, access methods, data structures, policies, or other technical characteristics at any time.

Such changes may affect the availability or functionality of the Service.

4. Marketplace Data

The Service may display listing information obtained from supported third-party marketplace sources.

Such information may include, depending on availability:

listing title; product information; listing price; condition; listing status; seller-related information; listing dates; marketplace identifiers; images or other listing-related information; and links to the original source.

The availability and accuracy of this information may vary.

JapanScanner does not guarantee that marketplace information is complete, current, accurate, or error-free.

Users should verify important information directly with the original third-party source.

5. No Guarantee of Listing Detection

JapanScanner is designed to monitor and detect marketplace activity, but monitoring results are not guaranteed.

We do not guarantee that:

every listing will be detected; every matching listing will be detected immediately; every price change will be detected; every marketplace update will be detected; every alert will be delivered without delay; marketplace information will always be available; third-party sources will remain accessible; or the Service will operate without interruption.

Monitoring may be affected by technical limitations, source changes, network conditions, maintenance, third-party outages, or other factors outside our reasonable control.

6. Accounts

Certain features require you to create an account.

You agree to provide accurate and current information when creating and maintaining your account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You must notify us promptly if you believe that your account has been accessed without authorization.

We may suspend or terminate accounts that violate these Terms or applicable law.

7. Subscriptions

Certain features of JapanScanner are available only through paid subscriptions.

Subscription plans, prices, billing periods, usage limits, and included features are displayed on the applicable pricing page.

By purchasing a subscription, you authorize the applicable payment provider to charge the applicable subscription fee according to the billing terms presented at checkout.

Subscriptions may automatically renew unless canceled before the next renewal date, subject to the terms presented at checkout and applicable law.

8. Changes to Subscription Plans

We may modify subscription plans, features, usage limits, or prices from time to time.

If a change affects an existing paid subscription, we will provide notice where required by applicable law.

Price changes will generally apply to future billing periods rather than periods that have already been paid for, unless otherwise permitted by applicable law.

9. Cancellation

You may cancel your subscription using the cancellation functionality provided in your account or through the applicable payment provider.

Unless otherwise stated, cancellation stops future renewal but does not automatically provide a refund for a billing period that has already started.

Your access to paid features may continue until the end of the applicable paid billing period.

Nothing in this section limits any mandatory cancellation or refund rights provided by applicable law.

10. Refunds

Refunds are governed by the JapanScanner Refund Policy.

The Refund Policy forms part of these Terms.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.

11. Acceptable Use

You agree to use JapanScanner only for lawful purposes.

You must not use the Service to:

violate applicable law or regulation; infringe intellectual property rights; circumvent security or access controls; interfere with third-party systems; attempt to gain unauthorized access to systems or data; use the Service to conduct fraud or deceptive activities; abuse, disrupt, overload, or interfere with the Service; attempt to reverse engineer or extract source code from the Service, except where expressly permitted by applicable law; use automated methods to access the Service in a manner that exceeds reasonable or authorized use; resell or sublicense access to the Service without our written authorization; or use the Service to facilitate unlawful transactions.

You must also comply with applicable terms, policies, and restrictions of third-party sources when accessing or acting upon information obtained from them.

12. Intellectual Property

The JapanScanner software, website, user interface, branding, design, documentation, and original content are owned by or licensed to JapanScanner and are protected by applicable intellectual property laws.

Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Service for its intended purpose.

You do not acquire ownership of the Service or its underlying software.

13. Third-Party Content and Links

The Service may contain links to third-party websites.

We do not control or guarantee the availability, accuracy, security, or content of third-party websites.

A link to a third-party website does not constitute an endorsement, sponsorship, partnership, or affiliation unless explicitly stated.

Your use of third-party websites is governed by their respective terms and policies.

14. Service Availability

We aim to provide reliable access to JapanScanner but do not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of:

maintenance; updates; technical failures; network problems; security incidents; third-party service interruptions; marketplace source changes; or circumstances beyond our reasonable control. 15. Disclaimers

To the maximum extent permitted by applicable law, JapanScanner is provided on an "as is" and "as available" basis.

We do not guarantee that:

the Service will meet every user's requirements; monitoring results will always be complete or accurate; listing information will remain available; alerts will always arrive immediately; third-party marketplace sources will remain accessible; or the Service will be free from errors or interruptions.

JapanScanner is a monitoring and research tool. Information provided by the Service should not be treated as a guarantee of product availability, pricing, seller behavior, transaction outcomes, or investment or financial results.

16. Limitation of Liability

To the maximum extent permitted by applicable law, JapanScanner will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, data, or goodwill arising from or related to your use of the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless JapanScanner from claims, liabilities, damages, losses, and reasonable expenses arising from:

your unlawful use of the Service; your violation of these Terms; your violation of third-party rights; or your misuse of information obtained through the Service. 18. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the Service, by email, or by other reasonable means.

The updated Terms will become effective on the date stated in the updated Terms.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.

19. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

you materially violate these Terms; your use creates a security or legal risk; required by law; your subscription remains unpaid; or continued access is otherwise reasonably necessary to protect the Service or other users.

Where appropriate and legally required, we will provide notice before termination.

20. Governing Law

These Terms are governed by the laws applicable to the relationship between you and JapanScanner, subject to any mandatory consumer protection rights that apply in your jurisdiction.

If you are a consumer, nothing in these Terms prevents you from exercising mandatory rights available under the laws of your country or place of residence.
